Cosmetic products must have a legal entity responsible for ensuring that most product requirements are met.
Every cosmetic product placed on the market must have a responsible person (RP). The RP is responsible for most of the requirements in the regulations.
In these cases, you are the RP
You are the RP when you
- produce cosmetic products
- import cosmetic products into the EU/EEA
- distribute and market a cosmetic product under your name or trademark, or modify a product already on the market in such a way that compliance with the applicable requirement may be affected
This is what the RP is responsible for
The RP and the distributor are both responsible for ensuring that most of the regulation's requirements are met. The exception is national language requirements and some minor details, for which only the national distributors are responsible. Further down you will see who is a distributor.
The RP shall, among other things, ensure
- safety assessment
- labelling
- substance restrictions
- traceability (applies throughout the entire supply chain)
- notification to the cosmetic products notification portal CPNP
The RP shall also prepare, maintain and store the product information file (PIF/dossier)
